JAPACAR Service Agreement

These terms govern JAPACAR membership for international buyers. By registering as a JAPACAR member, you agree to the following.

1. Purpose of Membership

Japanese Car Trading LLC ("JAPACAR") provides Japanese used-car procurement and export services to international buyers ("Members"). Free registration grants the Member the right to participate in JAPACAR's auction research and procurement support. Membership is free, has no expiry, and does not itself include any vehicle.

2. Confidentiality of Auction Information

Member acknowledges that auction data — including but not limited to vehicle photographs, inspection sheets, condition reports, auction grades, lot numbers, auction venues, starting prices, and winning bids — is proprietary information of Japanese auction venues and aggregators. Member agrees to:

  • Use this information solely for evaluating their own potential vehicle purchase through JAPACAR;
  • Not republish, redistribute, share, or disclose such information to any third party;
  • Not use such information to participate in Japanese auctions through any other agent or directly;
  • Treat all information as confidential business communications during and after the membership period.

Violation of this clause may result in immediate termination of membership.

3. Scope of JAPACAR's Services

JAPACAR acts as a procurement agent on the Member's behalf. JAPACAR does not warrant the condition or fitness of any vehicle, as Japanese auction grades and condition reports are produced by independent third-party inspectors. JAPACAR will exercise professional diligence in candidate selection but is not liable for inspector errors or omissions in the original auction documentation.

4. No Guarantee of Purchase

Membership does not guarantee that a suitable vehicle will be found or that JAPACAR will successfully win any auction. If the Member chooses to proceed to bidding on a specific vehicle, a separate Auction Bidding & Deposit Agreement — containing all applicable fees, deposit terms, refund and cashback conditions — will be presented at that time. Membership itself involves no payment and no commitment to bid.

5. Communication and Notices

All communication between JAPACAR and the Member will be by email or via the Member portal. The Member shall maintain a current email address and is responsible for monitoring it during the membership period.

6. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Japan. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance.

7. Modification

JAPACAR may modify these terms with reasonable prior notice to the Member, posted on the Member portal or sent by email. Continued use after notice constitutes acceptance.
