Terms of Service

The terms of use (Hereinafter "Terms") include various services provided by the Company in the cross-border automobile matching service "JAPACAR" operated by the Japanese Car Trading LLC (Hereinafter "Company"). In using this service (Hereinafter "this service"), the matters that must be observed by registered users and the relationship between our company and registered users are stipulated. If you use this service as a registered user, please be sure to read the full text before agreeing to this agreement.

Article 1. Content of the Service and the Company's Role

The Service is a website or an application that provides a place where customers can smoothly buy and sell automobiles in Japan with prospective buyers from overseas. The customer is responsible for all aspects of the sales contract, listing, and warranty of the purchase. In addition, we are not involved in the cancellation, termination, return, refund, or guarantee of the sales contract. However, in the case of transactions through the Company's cooperative services, the terms and conditions of each service shall take precedence. Article 2. Definition of Terms

  • "Seller" means a member who intends to sell a car using the service, and the seller of a concluded sales contract.

  • "Usage fee" refers to the consideration paid by the member to JAPACAR for the use of the service.
  • "Cooperative services" refers to services operated by or affiliated with JAPACAR.

Article 3. Agreement to the Terms of Use and Changes to the Terms of Use

Article 6. Member withdrawal

Article 8. Trading support service

2.Sales contracts, negotiations, contacts, etc. established using the sales support service are all contracts between members, and we are not a party.

3.exhibition

Listing means entering basic information on this site or app and clicking the listing button to disclose the information of the car to other members and notify them that they intend to sell it. In addition, the exhibition will be a car located in Japan. Members can request us to do what they need to sell or sell by using a paid optional service. However, even if the car is put up using our service, it does not mean that we put it up, and the member bears the obligation as an exhibitor, and we do not take any responsibility. Documents for export to Japan and vehicles whose automobiles are in Japan can only be exhibited.

4.Exhibitor's duty

Sellers are always obliged to post accurate information. If the car condition changes after listing, the content must be changed without delay. Similarly, the photos posted must not include photos in which the condition of the car is different from the condition of the vehicle concerned. The seller is obliged to promptly resolve any contact, inquiry, complaint, claim, etc. from other members at his / her own risk. If the listing causes damage to our company or other members, we will compensate at our own risk and expense.

5.purchase

It means to apply for a sales contract to the seller by purchasing and clicking the successful bid button on this site or application. In addition, when the successful bid button is pressed, the seller approves the sale and considers that the sales contract has been concluded.

6.Buyer's duty

The purchaser must understand that he / she is willing to make a purchase when he / she presses the successful bid button, and must use this site function to ask questions or matters that require confirmation before making a purchase. The purchaser shall make a purchase after fully understanding that the purchase application on this site is a manifestation of intention that has legal effect. Buyers must not negotiate or contact sellers using any method other than this site.

Article 9. Others

Members are obliged to accept proposals, if any, so that we can smoothly resolve any troubles or disputes that occur between members within this service.

Article 10. Governing law and court of jurisdiction

The governing law regarding the establishment and effect of this service contract shall be Japanese law, and the court of jurisdiction shall be the Tokyo District Court for all disputes arising from this service.
